The House passed bill 2847 which includes a $13 billion payroll tax
break for businesses that hire unemployed workers

First, it would exempt businesses hiring the unemployed from the
6.2 percent Social Security payroll tax through December and give
them an additional $1,000 credit if new workers stay on the job a full
year. The Social Security trust fund would be reimbursed for the lost
revenue.

EEOC

The US Equal Employment Opportunity Commission's (EEOC)
long-awaited new proposed rule on the definition of "reasonable
factors other than age" (RFOA) under the Age Discrimination in
Employment Act (ADEA) is scheduled for publication in the Federal
Register on February 18, 2010.
On March 31, 2008, the EEOC published a notice proposing to amend
its regulations to reflect the Supreme Court's decision in Smith v
City of Jackson ( 86 EPD ¶41,882) (See 73 FR 16807). That proposed
rule would revise 29 CFR 1625.7(d) to state that an employment
practice that has an adverse impact on individuals within the
protected age group on the basis of older age is discriminatory
unless the practice is justified by a "reasonable factor other than
age." The proposed revision also would require that the individual
challenging the allegedly unlawful employment practice bear the
burden of isolating and identifying the specific employment practice
responsible for the adverse impact. Additionally, the EEOC proposed
to revise 29 CFR 1625.7(e) to state that, when the RFOA exception is
raised, the employer has the burden of showing that a reasonable
factor other than age exists factually.
